Constable Willie Howell and the employees of the Brazoria County Constable's Office Precinct 2 are committed to principled performance of service in the public safety interest. Complaints

During the 77th Texas Legislative Session, Senate Bill 1074 was successfully passed. This bill was designed to address a growing concern regarding the practice of racial profiling in the law enforcement profession. Specifically, this bill mandates that police agencies in the State of Texas shall implement a policy that complies with Section 1, Articles 2.131, 2.133, and 2.134, of the Texas Code of Criminal Procedure, by no later than January 1, 2002. As such, the Brazoria County Precinct 2 Constable's Office has instituted a policy that addresses racial profiling and provides a complaint/compliment process for those who believe they have been stopped or searched based on racial, ethnic, or national origin profiling.

Two of the fundamental rights guaranteed by the United States and Texas Constitutions are equal protection under the law and freedom from unreasonable searches and seizures by government agents. The right of all persons to be treated equally and to be free from unreasonable searches and seizures must be respected. Racial profiling is an unacceptable patrol tactic and will not be condoned.

It is the practice of the Brazoria County Precinct 2 Constable's Office to police in a proactive and responsible manner and to enforce state and federal laws without regard to race, ethnicity, or national origin. All Brazoria County Precinct 2 Constable's Deputies are expected to conduct themselves in a dignified and respectful manner when dealing with the public.

The Office of Professionalism, Ethics and Training (O.P.E.T.) will NOT investigate any complaint regarding the validity of a traffic citation or appropriateness of any charges filed in connection with a police investigation. The appropriate venue to dispute tickets/charges is the court of which the Citation was issued.

Per Texas Local Government Code 614.021: Complaints Against Peace Officers include Constables and Their Deputies as authorized by Article 2.12 of the Texas Code of Criminal Procedures. 

Texas Local Government Code 614.022: 

To be considered by the head of a state agency or by the head of a fire department or local law enforcement agency, the complaint must be:

(1) in writing; and

(2) signed by the person making the complaint.

NOTICE: 

The Brazoria County Precinct 2 Constable's Office receives all complaints against our staff, including sworn peace officer. However, as referenced above by the Texas Local Government Code 614.022, any complaint that any person is requesting to be investigated, regardless of whether or not action is taken against the accused employee, MUST be in writing and signed. You may contact our office by email or mail, however you may receive correspondence back requesting that you file a sworn statement or affidavit of facts in regards to your complaint. Failure or Refusal to do so may lead to a dismissal of your complaint.
