Brazoria County Wins Appellate Court Decision in Tracy Read Employment Case

Brazoria County has successfully won the appellate court case of Brazoria County v. Tracy Read. The decision was rendered on November 19, 2024, by a panel consisting of Justices Kelly, Landau, and Rivas-Molloy.

The appeal originated from the 149th District Court of Brazoria County under trial court number 118810-CV. It challenged an order signed on October 30, 2023, denying Brazoria County’s plea. After reviewing the appellate record and the arguments, the Court found reversible error in the initial trial court’s decision. As a result, the appellate court reversed the lower court’s order and issued a judgment dismissing Appellee Tracy Read’s claims with prejudice. Because Read did not show that the County took an adverse employment action against him, the County retains immunity. We reverse and render Judgment dismissing this suit with prejudice. 

The Court also ordered Tracy Read to pay all appellate costs and directed that this decision be certified to the lower court for compliance.
